Terms of use
These terms apply to the game Death Laps (in the browser, on Android, on iOS and on the other platforms it is released on), to the online game servers and to the deathlaps.com website. By playing or using the website, you agree to them. Please also read the Privacy policy, which explains what we do with your data.
Who we are
Death Laps is developed and published by POLICODE GAMES, a brand of POLICODE LTDA, CNPJ (Brazilian company number) 42.868.011/0001-38 (“we”). Reach us at [email protected].
Age and parents
If you are not yet old enough to accept these terms on your own where you live (18 in Brazil), you may only play with the permission of a parent or guardian, who accepts these terms on your behalf and is responsible for your use of the game, including purchases.
The first time you open the game, we ask for your year of birth to fit the game to your age: children aged 12 or under see no ads, and anyone under 18 can only make real-money purchases after an adults-only check. In Settings → Account & Purchases → Parental controls, an adult can turn off purchases and rewarded videos.
Online account
- The offline game (championships, quick race and garage) needs no account. To play online, you can play anonymously (your online progress stays on that device only) or create an account with your email. There is no password: each time you sign in we send a code to your email.
- Your account is personal. Keep your email secure, because whoever controls it controls the account. The account is active on one device at a time: signing in on another one ends the session on the previous one.
- Your driver name is chosen once and cannot be changed. It must not be offensive, impersonate another person or brand, or contain personal data (such as a phone number or address). We may change or remove names that break these rules.
- Do not sell, lend or transfer your account.
- You can delete your account whenever you want, from within the game: see Delete account.
License to play
The game and everything in it (cars, tracks, art, music, sounds, texts, trademarks and code) belong to POLICODE or to those who licensed them to us. We give you a personal, non-exclusive, non-transferable and revocable license to play Death Laps for entertainment, in accordance with these terms.
You may not copy, sell, rent or distribute the game, or modify, decompile or reverse engineer it (except where the law allows). You may record and stream your races and publish videos and images of the game, including on monetized channels, as long as you do not suggest that the content is official or sponsored by us.
Money, Skulls and virtual items
- In-game money ($) is earned by playing. The offline and online balances are separate, and online money cannot be bought. Skulls (💀) can be earned by playing or bought.
- Currencies and virtual items are a license to use them within the game: they have no value outside it, cannot be exchanged for real money or sold or transferred to other accounts, and are not refundable, except where the law or these terms say otherwise.
- The contents of money cases are fixed and shown before you buy: there is no draw.
- To keep the game balanced, we may adjust in-game prices, prizes and the stats of cars and weapons. We may also correct balances and items obtained through a mistake, a bug or cheating.
Purchases and refunds
- The price is shown before each purchase, with taxes as set by the store.
- On phones, purchases are made through the App Store (Apple) or Google Play, under those stores' rules. In the browser, they are processed by RevenueCat, with payment by Stripe, and require a Death Laps account with an email. We never receive your card details.
- Skull packs are consumable. Permanent products (such as the Lifetime Sponsorship, which removes ads) are tied to your store account on phones, or to your Death Laps account in the browser. The “Restore purchases” button brings back permanent products; Skull packs are not restored.
- Purchases with a pending payment (such as Pix or boleto) are only delivered once confirmed.
- Refunds for purchases made on phones are requested from Apple or Google, who decide under their own rules. For purchases made in the browser, you may cancel within 7 days (article 49 of Brazil's Consumer Protection Code) by writing to [email protected]; we also handle refund requests when there is a problem with a purchase that we cannot fix.
- When a purchase is refunded or charged back, what it gave is taken back: the Skulls are deducted (the balance may go negative) and permanent products stop working.
- None of this limits the rights that the law of your country gives consumers.
Ads
The game may offer rewarded videos: you choose to watch one to earn a bonus. They come from Google, are not personalized and are filtered by age group. Children aged 12 or under see no ads, and neither does anyone who buys the Lifetime Sponsorship (the video bonuses become free).
Online play and rules of conduct
Online, you race other people in real time, join public or private rooms and talk in the lobby and room chats, which everyone there can read. So that every race is fun for everyone, you may not:
- cheat: use hacks, bots or programs that play for you, tamper with the game or what it sends to the server, or take advantage of bugs instead of reporting them to us;
- harass, threaten, discriminate against or insult other people, or use hate speech or sexual, violent or illegal content in the chat, in your driver name or in your car's paint;
- send spam, run scams, advertise or share malicious links;
- expose your own or other people's personal data (such as a phone number, address or social media);
- impersonate another person, POLICODE or our team;
- attack or overload the servers, or try to get into them or into someone else's account without permission;
- buy, sell or trade accounts, currencies or items outside the game.
The owner of a room can remove someone from it. If someone breaks these rules, depending on how serious it is, we may remove their driver name, undo what was obtained unfairly, and suspend or close the account. To report someone, write to [email protected] with their driver name, the time and what happened. The chat is not recorded and we do not watch it in real time; do not share anything there that you would not say in public.
A game in development
Death Laps is in active development. Cars, tracks, modes, prices and game balance may change, and the servers may be down for maintenance or because of technical problems. Rankings are seasonal and start over every season. During testing phases (such as the Closed Beta), we may need to reset online progress, giving notice beforehand whenever possible. If we ever shut down online play, we will announce it in the game or on the website at least 30 days in advance; the offline game keeps working on your device.
Suspension and termination
You may stop playing and delete your account at any time. We may suspend or close accounts that break these terms, in proportion to the breach; in serious cases (such as purchase fraud, attacks on the servers or threats), immediately. When an account is closed, its money, Skulls and items cease to exist, without a refund, except where the law says otherwise.
Warranties and liability
We work to keep the game running well, but it is provided as is, and we do not guarantee that it will always be available or free of bugs. To the extent the law allows, we are not liable for indirect damages or for problems caused by your connection, your device or third-party services (such as app stores). Nothing in these terms excludes or limits liability that the law does not allow to be excluded, such as under consumer protection laws.
Changes to these terms
We may update these terms when the game or the law changes. The date at the top shows the version in force, and important changes will be announced in the game or on the website before they take effect. If you keep playing after that, the new terms apply to you; if you do not agree with them, you can stop playing and delete your account.
Governing law
These terms are governed by the laws of Brazil. Consumers in Brazil may bring any dispute before the courts where they live. If you live in another country, you keep the protections that your local law gives consumers. Before anything else, talk to us: most problems are solved by email.
